Negotiation and Dispute Resolution
MBH Advocates assists clients with negotiation, mediation, settlement terms and alternative approaches to resolving disputes in the UAE. The consultation begins with your objectives, the documents available and the current stage of the matter.
To prepare for a consultation, gather the underlying agreement, a chronology, key correspondence, evidence of the claim and any settlement proposals. Highlight disputed points and tell the team about any notice, hearing or other time-sensitive development.
We discuss the issues raised by the documents and the available next steps for your matter. The proposed approach depends on the facts, applicable rules and competent authority; no outcome or timeframe is guaranteed.

Why Choose MBH Advocates And Legal Consultants for ADR?
Court Litigation Across the UAE
Our dispute resolution lawyers advise and represent clients in proceedings before the competent UAE courts, subject to the jurisdiction and circumstances of each matter.
Our litigation services include:
- Civil and commercial claims
- Contractual disputes
- Corporate and shareholder disputes
- Real estate and construction disputes
- Banking and financial disputes
- Debt recovery and enforcement proceedings
- Employment and labour disputes
- Insurance and compensation claims
- Professional negligence disputes
- Urgent and precautionary applications
- Appeals and cassation proceedings
- Recognition and enforcement of judgments
Every dispute is reviewed carefully to determine the relevant jurisdiction, applicable law, evidentiary requirements, limitation periods and available procedural remedies.
Where a matter involves federal courts, local emirate courts, the Dubai International Financial Centre Courts, the Abu Dhabi Global Market Courts or a free-zone authority, the jurisdictional position must be assessed independently before proceedings are commenced.
A Commercially Focused Dispute Strategy
An effective dispute resolution strategy should not be limited to filing a case. It should consider the client’s commercial position, available evidence, recoverability, business relationships and enforcement prospects.
At the beginning of an engagement, we assess matters including:
Jurisdiction and Applicable Law
We determine which court, tribunal or arbitral forum may have jurisdiction and identify the laws governing the dispute.
Strength of the Evidence
We review contracts, correspondence, invoices, payment records, expert reports, electronic communications and other documents that may support or undermine the claim.
Interim Protection
Where necessary, we consider urgent legal measures intended to preserve assets, protect evidence or prevent further harm, subject to the requirements of the competent authority.
Financial and Commercial Risk
We assess the amount in dispute, litigation costs, possible counterclaims, recoverability and the practical consequences of pursuing or defending proceedings.
Settlement Opportunities
Where settlement is commercially appropriate, we assist clients in negotiating clear and enforceable terms that protect their legal and financial interests.
Enforcement
A successful judgment or award has limited value unless it can be enforced. Enforcement considerations should therefore form part of the strategy from the outset.
Our team combines in depth legal knowledge with strong negotiation and arbitration skills to design strategies that work in your favor. We ensure the process is efficient, confidential, and tailored to your unique needs, allowing you to save time, reduce costs, and protect valuable relationships.
What sets us apart is our commitment to results. We carefully assess each case, recommend the most suitable ADR approach, and guide you every step of the way. With Mbh advocates and legal consultants, you gain trusted legal partners who are dedicated to resolving disputes effectively while safeguarding your long-term interests.

UAE alternative dispute resolution: key legal questions
Federal Decree-Law No. 40 of 2023 on Mediation and Conciliation in Civil and Commercial Disputes is a principal federal framework for mediation and conciliation. Arbitration, where agreed, is governed separately by Federal Law No. 6 of 2018, as amended, and any applicable institutional rules.
The forum depends on the chosen process. Court-connected conciliation or mediation may involve the competent judicial authority or mediation centre, while arbitration is handled by the agreed arbitral institution or tribunal with court support where required.
The underlying contract, dispute-resolution clause, notices, settlement correspondence, commercial records, payment evidence, expert reports and documents showing the parties’ positions and settlement authority are commonly important.
ADR can result in a negotiated settlement, mediated or conciliated settlement, or a binding arbitral award where arbitration is used. The enforceability of the outcome depends on the process and how the settlement or award is documented.
Typical stages include early case assessment, selection of the ADR route, appointment of a mediator or tribunal where needed, exchange of positions and evidence, negotiation or hearing, settlement or award, and enforcement if required.
Yes. DIFC and ADGM have their own courts and ADR frameworks, and many free-zone contracts use institutional arbitration. Jurisdiction, seat, governing law and enforcement should be checked before selecting the process.
Last reviewed: 23 September 2026. ADR rules and institutional procedures should be checked against the current legislation, contract and chosen forum.
